About the Cemetery Flower Program

1. Agreement: This agreement covers the provision of silk flower arrangements with installation by Serene Memorial Garden’s staff in a permanent vase located at the grave site specified for the deceased person listed on the form. The flower arrangements are solely for the listed deceased individual and will not be installed for any other individuals. The floral arrangements are made using a seasonal mix selected by the florist based on availability. The specific shape, color, height, design, and overall appearance of the flowers and arrangement details may vary according to the season and stock.

2. Cancellation: The purchaser may cancel this plan within three (3) days of the contract date, provided the flowers have not yet been shipped. After this period, the plan becomes non-refundable. If cancellation occurs after the flowers have been shipped, the purchaser will be responsible for all costs incurred. The purchaser may also request that the flowers not be installed, but this does not entitle the purchaser to a refund.

3. Payment: The purchaser agrees to pay a one-time, non-refundable fee via cash, credit card, debit card, or check. In the event of a bounced check or insufficient payment, all services will be suspended, and any installed merchandise will be removed until the balance is settled. The purchaser is responsible for any additional fees or charges incurred due to payment issues.

4. Installation: The purchaser acknowledges that if the vase at the grave site is missing or damaged, preventing proper installation, Serene Memorial Garden’s staff is not responsible for replacing the vase or installing flowers in any alternative or unapproved receptacle. The vase must adhere to the cemetery's rules and guidelines. During each installation period, old, faded, or damaged flowers will be removed and disposed of by our staff without notice. Flowers will not be saved or stored for later retrieval. Any flowers damaged upon delivery will be reordered at no additional cost to the purchaser before installation. After installation, Serene Memorial Gardens and Holder-Wells are not liable for any damage caused by weather, ultraviolet (UV) exposure, acts of God, vandalism, theft, or any other circumstances beyond our control.

5. Dates: Delivery and installation dates are subject to change based on weather conditions, shipping delays, holidays, and product availability. Estimated delivery dates are March 1st for Spring, June 1st for Summer, September 1st for Fall, and December 1st for Winter. Installation may take up to two (2) weeks following delivery, depending on weather and site conditions. The purchaser will be notified of any significant delays beyond (31) days from estimated delivery date or changes to the schedule by either phone or email.

6. Limitation of Liability: Serene Memorial Gardens and Holder-Wells shall not be liable for any indirect, incidental, consequential, or punitive damages arising from this agreement, or the services provided, even if advised of the possibility of such damages. Our maximum liability shall not exceed the total amount paid by the purchaser under this agreement.
